REALPOST PRIVACY POLICY

  1. The services provided via the RealPost app (the "App") comes to you free and is intended for use as is.
  2. This RealPost Privacy Policy ("Privacy Policy") is used to inform App users of our policies with respect to the collection, use, and disclosure of Personal Data.
  3. If you choose to use the App, then you agree to the collection, use and disclosure of Personal Data as described in this Privacy Policy. The Personal Data that we collect is used for providing and improving the App. We will not use or share your information with anyone except as described in this Privacy Policy.
  4. The terms used in this Privacy Policy have the same meaning as those contained in our Terms of Use, which is accessible on the App, unless otherwise defined in this Privacy Policy.
  5. Definitions and interpretation

  6. In this Privacy Policy, the following terms have the following accompanying meanings:
    1. "IP" means Internet Protocol.
    2. "Log Data" has the meaning attributed to it at Clause 17 below.
    3. "Personal Data" means any data, whether true or not, about an individual who can be identified (a) from that data; or (b) from that data and other information to which we have or are likely to have access, including data in our records as may be updated from time to time.
    4. "PDPA" means the Personal Data Protection Act 2012.
    5. "Principals" means the persons whom you are an agent for with respect to the property listings you upload or download into the App.
    6. "Privacy Policy" means this privacy policy.
  7. In this Privacy Policy, references to "you" and "your" refer to you, the end user of the App, and references to "we", "our", and "us" refer to 99 Pte Ltd, the proprietor of the App.
  8. Collection and Use

  9. For a better experience, while using the App, we may require you to provide us with certain Personal Data, including but not limited to names, CEA registration numbers, email addresses, telephone and handphone numbers, photographs, addresses, details of premises. It may also include transactional information based on your activities, such as the content that you generate or that relates to your account, as well as other information from your interaction with the App, including computer and connection information, statistics on page views, traffic to and from the App, advertising data, IP addresses and standard web log information. The information that we request will be retained by us and used as described in this Privacy Policy.
  10. We may use your Personal Data for the following purposes:
    1. verify your identity, update our records and generally maintain your Account with us;
    2. provide our services and customise the content shown to you;
    3. develop, operate, improve, deliver and maintain our services;
    4. respond to your queries and resolving complaints;
    5. carry out polls, surveys, analysis and research on how our services are being used and how we can improve them;
    6. update you on your listings and our services (e.g. new offers, new chats, new feedback, new comments);
    7. send you marketing and/or promotional materials on our latest products and services of carefully selected third parties, so long as you consent to it;
    8. send you service-related messages including, without limitation, a welcome/confirmation email when you register your account and to enforce our Terms of Use and other policies;
    9. perform functions of the App or as otherwise notified to you at the time of collection;
    10. prevent potentially prohibited or illegal activities;
    11. comply with our legal obligations and requirements; and/or
    12. enforce obligations owed to us.
  11. If you provide us with any Personal Data or other information relating to a third party, by submitting such Personal Data or other information to us, you represent and warrant to us that you have obtained the consent of that third party to provide us with their Personal Data or other information for the respective purposes. In this regard, you agree to indemnify us against any complaint, claim, damage, loss, penalty or fines relating to this representation and warranty on Personal Data or other information relating to the third party.
  12. The App may use third party services that may collect information used to identify you and/or your Principals, such as Google Play Services and Apple App Store.
  13. In the event of any inconsistency between the terms of this Privacy Policy and the privacy policies of the third party service providers listed above, the terms of this Privacy Policy shall prevail.
  14. Disclosure and sharing of Personal Data

  15. We will take reasonable steps to protect your Personal Data against unauthorised disclosure.
  16. We may disclose your Personal Data to third parties who are engaged to provide services to us and help with our business operations. These third parties include companies and individuals that perform tasks such as processing transactions, fulfilling requests for information, receiving and sending communications, updating marketing lists, analysing data and providing support services. They will only have access to your Personal Data to the extent necessary to perform their functions.
  17. We may share the information with our potential partners, investors and other parties with a view to a potential business partnership, collaboration, joint venture or otherwise in furtherance of our business.
  18. We may also share your Personal Data with regulatory authorities, statutory bodies or public agencies for the purposes of complying with their respective requirements, policies, directives, guidelines and/or contracts.
  19. We may disclose your Personal Data if we believe that such action is necessary to prevent fraud or crime or to protect our services or the rights, property or personal safety of any person, or for such other reason as allowed under the PDPA.
  20. Log Data

  21. We want to inform you that whenever you use the App, in a case of an error in the App, your data and information (through third party products), including but not limited to Personal Data, may be collected on your device. Such data and information is termed "Log Data". Such Log Data may include information such as your device's IP address, device name, operating system version, the configuration of the App when utilising the App, the time and date of your use of the App, and other statistics.
  22. Cookies

  23. Cookies are files with small amount of data that is commonly used as an anonymous unique identifier.
  24. The Service does not use these “cookies” explicitly. However, the App may use third party code and libraries that use “cookies” to collection information and to improve our services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of the App.
  25. Service Providers

  26. We may employ third-party companies and individuals due to the following reasons:
    1. To facilitate the App;
    2. To perform service-related maintenance; and/or
    3. To assist us in analysing how the App is used.
  27. We want to inform users of the App that these third parties have access to your Personal Data. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.
  28. Links to Other Sites

  29. The App may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites may not be operated by us. Even if they are, they may be governed by different sets of privacy policies. Therefore, we strongly advise you to review the privacy policies of those websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
  30. Protecting Personal Data

  31. We will take reasonable efforts to protect Personal Data in our possession or under our control by making reasonable security arrangements to prevent unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks. However, we cannot guarantee the security of any personal data we may have collected from or about you, or that no malicious code (such as viruses, bugs, trojan horses, spyware, adware or other malware) will enter the platforms on which personal data is hosted.
  32. While we strive to protect Personal Data, we cannot ensure the security of the information you transmit to us via the Internet or when you use the App. We urge you to take every precaution to protect your Personal Data when you are on the Internet. No method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.
  33. Access, correction and update of information

  34. You may request access or make corrections to your Personal Data held by us. We may charge a fee for processing your request for access. Such a fee depends on the nature and complexity of your access request. Information on the processing fee will be made available to you upon request.
  35. You may contact us for details on how you may request such access or corrections, or for any other queries relating to the handling of your Personal Data, at the email address set out at Clause 32 below.
  36. Retention of data

  37. Personal Data is retained as long as the purpose for which it was collected remains and as long as it is necessary for any other legal or business purposes.
  38. Limitation on Liability

  39. For the avoidance of doubt, the "Disclaimers and Limitation of Liability" section in the Terms of Use shall apply to this Privacy Policy.
  40. Changes to This Privacy Policy

  41. We may update our Privacy Policy from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Privacy Policy on this page. These changes are effective immediately after they are posted on this page.
  42. Governing Law

  43. This Privacy Policy shall be governed by the laws of the Republic of Singapore, excluding its choice-of-law rules.
  44. In respect of any dispute arising from or in relation to this Privacy Policy, you and us agree to submit to the exclusive jurisdiction of the Singapore courts.
